You do not need council approval if your project meets the strict criteria for “Exempt Development” under the NSW State Environmental Planning Policy (SEPP).

For a deck or pergola to be exempt from council approval in Sydney, it must:

  • Be no higher than 1 metre above the natural ground level.
  • Have a total floor area of no more than 25 square metres.
  • Be setback at least 900mm from the property boundary.
  • Not be located in a heritage-listed area, a critical habitat, or a high-risk bushfire zone (BAL-40 or BAL-FZ).

If your deck or pergola exceeds any of these limits, you must apply for a Complying Development Certificate (CDC) or submit a Development Application (DA) to your local council. As licensed builders, we handle this entire assessment and approval process for you.

Neither material is universally “better”—the right choice depends on your lifestyle, budget, and location within Sydney.

  • Choose Hardwood Timber (Spotted Gum, Merbau, Blackbutt) if you want a natural, premium look, have a heritage home, or live in a bushfire-prone area requiring a high BAL-rating. Hardwood stands up beautifully to Sydney’s climate but requires oiling or staining every 12 to 18 months to prevent fading and splitting under intense UV exposure.
  • Choose Composite Decking (ModWood, Trex, Ekodeck) if you want a low-maintenance solution, live in a high-humidity coastal suburb, or are building a pool surround. Composite decking never requires sanding, staining, or oiling, does not splinter, and is highly resistant to rot, termites, and salt air. However, it has a higher upfront material cost and can get hotter under direct summer sun than light-coloured timber.

To build without council approval (as Exempt Development), your deck or pergola must be setback at least 900mm from your side and rear property boundaries.

If you want to build closer than 900mm to your boundary line:

  1. You must lodge a Development Application (DA) with your local Sydney council (e.g., Northern Beaches, Inner West, or Waverley Council).
  2. Your structure must comply with the National Construction Code (NCC) fire-safety regulations. Any timber structure built within 900mm of a boundary often requires fire-rated materials or treated timber shield walls to prevent the spread of flame between properties.

Yes, you can build a deck over concrete, but it requires a specialized low-clearance subframe and proper drainage planning.

Building directly on concrete presents two main challenges: clearance height and moisture trapping.

  • We use engineered structural aluminium or low-profile galvanised steel subframes instead of traditional timber joists. This allows us to keep the deck height as low as 50mm.
  • We install rubber packer systems beneath the subframe to allow rainwater to flow freely underneath to existing drains. Without this, water will pool, leading to timber rot, mould, and structural failure of the frame.

For coastal properties in suburbs like Bondi, Manly, Coogee, or Cronulla, we highly recommend Spotted Gum, Ironbark, or Tallowwood.

These are Class 1 durability Australian hardwoods with high natural oil densities. They are exceptionally resistant to:

  • Salt spray corrosion (which rapidly degrades softer woods).
  • High humidity and coastal moisture-induced wood rot.
  • Wind-driven sand abrasion.

When building along the coast, we also upgrade all structural subframe fixings, screws, and brackets to Grade 316 Marine-Grade Stainless Steel to prevent tea-staining and rust failure.

  • A professionally installed hardwood timber deck will last 25 to 35+ years, provided it is cleaned and oiled annually and has a well-ventilated, drained subframe.
  • A premium composite deck has an expected lifespan of 25 to 30 years and usually comes backed by a 25-year manufacturer warranty against fading, staining, and rotting.
  • A timber or steel pergola will easily last 20 to 30 years. Polycarbonate roofing sheets typically have a lifespan of 10 to 15 years before they require replacement due to UV degradation.
